General commercial terms and conditions
1. Scope
These general commercial terms and conditions apply to all orders and deliveries between Böthmen Pharma S.L, Avenida de la Llana 123, Rubí, 08191, Barcelona (Spain) (hereinafter “Böthmen”) and its customers through the online store www.storepetcare.com.
2. Orders and contracting
2.1. Placing orders
Böthmen offers its customers a wide variety of pet products. By clicking on the products or on the product descriptions, the customer can access the product details (for example: different designs, sizes or flavors). The product is stored in a virtual basket by entering the required quantity and clicking on the shopping cart symbol.
By clicking on the basket button, shown in the upper right corner of the online store, the customer accesses a summary page, and at any time can check the products that have been added to the basket and make changes whenever necessary.
If the customer does not wish to buy any more products, they can proceed via the “checkout” button. Registered customers can enter their username and password at this point to automatically use their stored information for the order. Alternatively, the customer can register as a new customer and create a customer account, or continue the purchase without creating a customer account. In such case, the customer must enter their address and billing information on the next page.
By clicking the “Continue” button, the customer reaches the penultimate order step, “Preview”. Here, the customer has access to a summary of their order with the price details (including VAT) and delivery service details and its cost.
The order is completed by clicking the “Order” button. This means that a binding offer has been made.
Böthmen does not charge fees for the use of distance communication systems, but the customer may incur the usual costs associated with the use of these services with third parties (for example, mobile operator, Internet provider).
2.2. Contracting
a. The products available in our online store www.storepetcare.com are aimed at individuals and businesses. Businesses are considered to be those natural or legal persons or partnerships with legal capacity who, when concluding a legal transaction, act in the exercise of their own commercial or professional activity. Each customer profile must be registered as such, with 4 user categories: Customer, Referred Customer, Veterinarian and Distributor. Veterinarian and Distributor will therefore have a professional profile. The user profiles are defined in section 3.
b. Images of the store range are intended as an illustration and do not constitute binding offers for sale. The customer, for their part, makes a binding offer to enter into a purchase contract by completing the order process and clicking the button. The customer then receives an automatic confirmation of receipt of the order by email (order confirmation). This order confirmation does not constitute acceptance of the offer. The contract with Böthmen is only concluded if Böthmen sends the ordered products (already paid) to the customer and this shipment is confirmed by email (shipping confirmation).
c. For the bank transfer payment option, payment information will be sent to the customer immediately upon placing the order so that they can make the payment. The order confirmation does not constitute payment information. For payments, the invoice amount becomes due upon receipt of the payment information and must be paid within 3 business days from receipt by bank transfer to the account indicated in section 8. Receipt of the invoice amount in our account is decisive for compliance with the payment deadline. If after 3 business days no payment has been recorded in the account indicated in section 9, the customer’s order will be cancelled.
d. The language of the contract is Spanish.
2.3. Contract content
The contract text will be stored by us until the order has been processed in full, after which it will be stored for retention in accordance with tax and commercial legislation. After receipt of the order by Böthmen, the buyer will receive an email confirmation from Böthmen with the essential content of the contract, including the general terms and conditions in force at the time of contracting. If you lose the documents relating to your orders, please contact us. We will be happy to send you a copy of your order data. The customer may access their order-related information from the customer area of our online store.
3. Website user profiles
The website www.storepetcare.com has 5 different user profiles listed below (DEFINE ALL PROFILE OPTIONS, SUCH AS SHIPMENT TRACKING, NEWSLETTER MANAGEMENT, SHIPPING MODIFICATION, DOWNLOAD INVOICES, REORDER…):
1. Guest customer
a. The guest customer profile does not require registration; their personal information will not be stored by Böthmen, but it will be requested in order to manage the single order that is placed.
2. Customer
a. The customer profile must register with their contact information, address and email. This is the basic profile with which you can add products to your basket and manage the purchase of products easily.
3. Referred Customer
a. The referred customer profile must register with their contact information, address, email and provide www.storepetcare.com with their referring veterinarian code (which their usual veterinarian must provide). This profile receives a discount on some products at www.storepetcare.com. It is a profile with which you can add products to your basket and manage the purchase of products easily.
4. Veterinary clinic
a. The veterinary clinic profile must register using a special form where they will provide their contact information, address, email and must provide their licensed veterinarian number to www.storepetcare.com. With this information we will finalize their registration as a veterinarian and their profile will be associated with the usual PVV, in addition to receiving a clinic code that they can share with their customers.
4. Prices and shipping costs
All prices include the statutory Value Added Tax (VAT) and other price components, and must be understood separately from any shipping costs that may be incurred. For destinations in the Canary Islands, Böthmen will cover island taxes: import taxes (AIEM) and customs fees (DUA).
5. Delivery
If no other period is specified for certain special products, the delivery time (after receiving payment for the product) is 2–4 business days for the Iberian Peninsula; 2–5 business days for the Balearic Islands, and 7–12 business days for the Canary Islands.
The delivery period begins the day after the contract is concluded, except in the case of payment by transfer; in this case, the period begins the day after receipt of the customer’s payment. If the last day of the period falls on a Saturday, Sunday or public holiday recognized by the State at the place of delivery, the period will automatically be extended to the next business day. Deliveries are exempt from customs duties within the EU (except the United Kingdom).
In the event that the products supplied are damaged during delivery, you must contact Böthmen Customer Service as soon as possible. As a result, Böthmen will have the option to submit a claim to the carrier or the carrier’s insurer regarding the damage caused. If the customer does not provide notification of transport damage, this will have no effect on the customers’ statutory warranty rights.
In order to manage orders in the best possible way and ensure our customers are properly informed about the status of their shipment, Böthmen provides the customer’s email address and, if specified, telephone number to the relevant transport company solely for delivery management purposes. In this regard, Böthmen takes into account both the customer’s interests and its own equally. Courier companies have a strict obligation to protect personal data and to use it solely for the purpose of providing shipment information. 6. Retention of title
The products shall remain the property of Böthmen until payment has been made in full.
Before the transfer of ownership, pledging, transfer of ownership as security, processing or redesign are not permitted without Böthmen’s approval.
7. Right of withdrawal
After completing an online sale, the user in principle has the legitimate right of withdrawal, about which Böthmen will subsequently inform in accordance with the legal model. A consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or entrepreneurial activity. This consumer (Guest customer, Customer, Referred customer) will have the right of withdrawal, whereas professional profiles (Veterinarian, Distributor) will not have such right.

Instructions for exercising the right of withdrawal
Right of withdrawal
As a customer of www.storepetcare.com, you have the right to withdraw from this contract within 14 days without giving any reason. This period will expire 14 days after you or a third party authorized by you, other than the carrier, acquires physical possession of the last of those goods. The products must be in perfect condition, with the packaging unopened and the seal in perfect condition; the packaging must not show any damage either. Any product that is not considered suitable for resale will not be refunded.
To exercise the right of withdrawal, you must notify us (Böthmen Pharma S.L, Avenida de la Llana 123, Rubí, 08191, Barcelona (Spain); tel.: +34 932 126 382; orders@groupandersen.com) of your decision to withdraw from the contract by means of an unequivocal statement (email). You may use the model withdrawal form, although its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the indicated deadline expires.
Consequences of withdrawal
In the event of withdrawal on your part, we will reimburse the payments received from you (excluding delivery and collection costs) without undue delay and, in any event, no later than 14 days from the date on which the products to be returned are received at Böthmen’s facilities. We will carry out such reimbursement using the same means of payment used by you for the initial transaction. If you require the refund to be made using a method different from the initial transaction, the customer must indicate this by sending an email to orders@groupandersen.com.
Return of goods

To make the return, we will send you the instructions by email. The transport company will issue a label and manage the return. The cost of the return must be paid directly by the customer or deducted from the subsequent monetary refund.
IMPORTANT: please contact our Customer Service directly to manage any change related to your return.
Exclusion of the right of withdrawal
The right of withdrawal will not apply in the cases provided for in Article 103 of Law 3/2014, of March 27, amending the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.

8. Warranty and liability
The applicable statutory warranty provisions apply.
Veterinary diet foods should only be used when they have been recommended and are regularly supervised by a veterinarian. The veterinarian must be visited regularly (every 6 months) during feeding with these products so that an examination can be carried out, and without delay in the event of deterioration of the pet’s health. Böthmen shall not be liable for the consequences of inappropriate use of veterinary diet foods, or unnecessary use. Veterinary products should only be used when they have been recommended and are regularly supervised by a veterinarian.
9. Payment methods, vouchers, default interest and other damages incurred
1. Payment methods
In principle, we offer you the possibility to choose between the following payment options: a) payment by debit card, b) payment by credit card, c) payment by PayPal, d) payment by bank transfer e) payment by Bizum. Böthmen reserves the right to accept only certain means of payment in particular cases or depending on the type of shipment selected by customers, as well as to not offer certain forms of payment or to accept only certain forms of payment and refer to other methods. Payment by sending cash or checks is not possible.
a. Payment by debit card
Payment by direct debit is only possible from accounts within the European Union. The debit will be made within one day after the goods are shipped. The pre-notification period is reduced to one day. In the event that credit institutions charge fees, Böthmen reserves the right to charge these to the customer. This applies in particular to debit notes due to insufficient funds in the account or incorrect bank details provided by the customer.
b. Payment by credit card
If payment is made by credit card, the amount will be charged within one week after the goods are shipped (we accept MasterCard, Visa, Diners Club and American Express).
d. Payment by PayPal
You can pay directly through your PayPal account. After placing your order, you will be redirected to PayPal and will authorize the order amount there. Once we have confirmation of your authorization, we will start processing the shipment according to the indicated timeframes. Immediately after authorization, the actual invoice amount will be charged to your PayPal account, once any possible discounts, gift vouchers, etc. have been deducted.
e. Payment by Bizum
Payment for the purchase must be made to the phone number indicated during the purchase process. After confirmation of payment, we will proceed with preparing and shipping the order.
f. Payment by bank transfer
If the customer wishes to [MB9] pay by transfer, the invoice amount must be transferred to the account mentioned below within 3 business days after receiving the payment information. The goods will only be shipped once payment has been received. If you do not transfer payment in full within 3 business days from receiving this payment information, we will cancel your order. IMPORTANT: to make a bank transfer it is essential to indicate the order number in the transfer reference. Otherwise, the order cannot be identified and therefore cannot be processed. You may send an email confirming the transfer to orders@groupandersen.com to speed up preparation and shipment. Bank transfers usually take 2 business days. It is only necessary to send the transfer receipt if the account holder and the customer are not the same person.
2. Coupons / discount vouchers
When redeeming promotional vouchers, the specific redemption conditions must be observed. The relevant information appears on the coupons.
Coupons cannot be combined with other offers or promotions. At checkout, the most favorable discount will be applied automatically.
4. Invoices
Böthmen has the right to send the customer the invoice electronically. Electronic invoices are sent in PDF format by email.
The sales tax invoiced does not entitle the customer to deduct it.

11. Marketing and customer communications
If, for the purchase of a product or the contracting of a service, the customer enters into a contract with Böthmen and thereby provides their email address, Böthmen may use that address to send direct advertising to the customer about products or services similar to those purchased.
The customer has the right at any time to object to the use of their email address for this purpose, without incurring any cost. Each email contains an unsubscribe link. Likewise, objections to this type of mailing can be declared at any time by email to drvet@groupandersen.com.

13. Final provision
If any provision of these general terms and conditions is or becomes invalid or unenforceable, the validity or enforceability of the remaining provisions of these general terms and conditions shall not be affected. Only Spanish law applies.
